CHILD PERFORMANCE LICENSING

PERFORMANCE LICENSE EXEMPTIONS

BODY OF PERSONS APPROVAL

Every child, from birth until their official school leaving date, is subject to the Children and Young Persons Act 1963, s.37, the Children (Performance) Miscellaneous Amendments) Regulations 1998 and the Children (Performance and Activities) (England) Regulations 2014.

 

If a child of school age or below is involved in performance activities, they must have an individual performance licence or be covered by a Body of Person Approval and be chaperoned at all times.

​

Some Local Authorities issue exemptions if the application meets a certain set of criteria but these are rarely issued.

​

Please note that Local Authorities may refuse to consider an application if the performance or activity is less than 21 days away.

CHILD PERFORMANCE LICENSING

Phoenix Child Performance Licensing provides an outstanding freelance service to production companies, producers, talent agencies, photographers and parents who require support with applying for child performance licenses within the UK (including Ireland).

 

The licensing system is designed to provide a check that those responsible for using children in performances (professional and amateur), in paid sport and modelling make suitable arrangements to safeguard them.

PROCESS MANAGEMENT

Managing a large number of Child Performance Licensing can be both time consuming and stressful. Casting Directors and Producers may be having to liaise with multiple agencies to ensure that Local Authorities issue Licenses in time for the proposed shoot date.

Phoenix Child Performance Licensing can remove this burden by applying for all the required licenses on your behalf or by managing the licensing process with the appropriate talent agencies who make the applications. Working in this manner frees up the time of the Casting Directors and Producers by only having to liaise with one person enabling them to concentrate on the finer details of the shoot.

PERFORMANCE
LICENSE
EXEMPTIONS

A child may be exempt from requiring a performance license if they meet the criteria below.   However, it is always best practice to check with the Local Authority (LA) concerned if this is appropriate as some LAs will issue an exemption letter.  

 

Even if a license is not required, there are still restrictions on the number of hours a child may participate in the performance and other guidance they must follow.

​

  • No payment other than offsetting expenses in respect of the child taking part in the performance, is made to the child or another person

  • No child named in the application has performed in the six months preceding the performance on more than four days (including this performance)

  • No child named in the application shall be absent from school due to taking part in a performance or rehearsal

PERSONS
APPROVAL

A BOPA, if granted, removes the need to apply for an individual licence for each child; it is granted to the organisation that is responsible for the performance. The approval is granted by the local authority where the performance is taking place. It is the organisation that is approved not the children.

A BOPA is normally applied for when large numbers of children are being filmed, however, there are very strict guidelines to follow when applying for a BOPA.

If a child is being paid or anyone else is receiving payment for the child to take part then a BOPA is not appropriate and a licence must be applied for.

​

If a child will be absent from school then a BOPA will not be appropriate and a licence must be applied for.

CHAPERONES

A child taking part in a performance or activity under licence or a rehearsal within the licensing period must be supervised at all times by a local authority approved chaperone unless they are under the direct supervision of their parent or a person who has legal parental responsibility or possibly their teacher. 

​

At present Phoenix Child Performance Licensing do not provide a Chaperone service, however, we may be able to assist you with finding a local Chaperone if needed. Going forward this may be something we can offer.

ICO REGISTRATION

Phoenix Child Performance Licensing are registered with the Information Commissioner’s Office (ICO). A copy of the registration certificate is available on request.
